It was much too deliberate and planned for this to have been inadvertent, which would make the crime pardonable. Without Libby's lies, the underlying crime could have been investigated. Yes, he's been a major party to a crime - the crime of treason, which constitutes 'high crimes and misdemeanors'. If they let him go to jail, the entire cabal knew it would risk his coming clean.
